Top Q: What is this litigation about?

A:

Two purchasers (now known as “Class Representatives”) filed a complaint in U.S. District Court in the District of Minnesota alleging that Allianz marketing and sale practices for specific Two-Tiered Bonus Annuities violated the Minnesota Prevention of Consumer Fraud Act and allowed for unjust enrichment by Defendant. 

Defendant denies each claim alleged in the complaint. To date the court has taken no position on the allegations raised by the Class Representatives, but has allowed the lawsuit to proceed as a class action.

Top Q: How do I know if I am a Class Member?

A:

Class Members include individuals satisfying all the following criteria:

1. A purchaser or beneficiary;

2. of one or more Allianz "Two-Tiered Bonus Annuities" policies (identified below) purchased between February 9, 2000 and May 10, 2007; AND,

3. the purchaser was NOT a California resident aged 65 or older at the time of purchase.

The Court has approved only the following "Two-Tiered Bonus Annuities" for this lawsuit:

Top Q: What happens if I was a CA resident aged 65 or older at the time of purchase?
  A:

The Court decided that all persons meeting this description are part of a lawsuit filed in the United States District Court for the Southern District of California.  That lawsuit—Iorio, et al. V Allianz Life Ins. Co. of N. Am, Case No. 05CV633—is separate from this litigation and no additional information is available on this website.

Top Q: Should I get my own lawyer?
  A: You do not need to hire a lawyer because class counsel is working on behalf of your interests. However, if you wish to retain your own lawyer you may do so at your expense.

Top Q: Is there a trial scheduled?

A:

No. The court has ordered all parties ready for trial by January 1, 2009, but has not scheduled a date for trial. Should a trial be necessary, the court will hear arguments at the United States District Court for the District of Minnesota, 202 U.S. Courthouse, 300 South 4th Street, Minneapolis, MN 55415.

Top Q: If a trial is scheduled, do I have to attend?

A:

No. Class Counsel will present the case for all class members, and Allianz will present their defenses. You are welcome to attend at your own expense.
